Nghị quyết số 415 của Quốc Hội Hoa Kỳ

Xét rằng khi Nước CHXHCN Việt Nam được lập ra, do một đảng độc nhất là đảng CS VN cai trị và kiểm soát, thì một chuyện rất thường xuyên xảy ra là nhiều người công dân Việt Nam đã bị tịch thu nhà cửa và của cải riêng tư mà không được bồi thường gì cả.
 
Xét rằng trong Hiến Pháp của nước CHXHCN Việt Nam, điều thứ 23 có nói rằng của cải cá nhân và của các hiệp hội đang sở hữu một cách hợp pháp thì sẽ không bị quốc hữu hóa;
 
Xét rằng theo Bộ Ngoại Giao (Department of State) (?), chúng ta cần làm thêm nhiều để bảo vệ quyền sở hữu tài sản của người dân trong nước Việt Nam; và
Xét vì dân chúng Hoa Kỳ ủng hộ mạnh mẽ cho sự tự do, dân chủ, và những nhân quyền căn bản của dân chúng trong nước CHXHCN Việt Nam: Bây giờ, bởi thế, quyết định rằng --

(1) Quốc Hội Hoa Kỳ --
(A) đón mừng những cố gắng mới đây của chính quyền nước CHXHCN Việt Nam đã cho phép người công dân Việt Nam được hưởng quyền sở hữu riêng tư về đất đai, và hy vọng là điều này sẽ được phát triển rất nhanh để bao gồm mọi tầng lớp công dân Việt Nam;
(B) yêu cầu Chính quyền nước CHXHCN Việt Nam hãy nhận biết rõ ràng và đầy đủ trách nhiệm để mà nhanh chóng trao trả một cách công bằng và hợp lý cho người dân những của cải mà nhà nước đã chiếm đoạt;
(C) yêu cầu Chính quyền nước CHXHCN Việt Nam hãy ra lịnh cho các viên chức địa phương, nhất là tại vùng Cao Nguyên Trung Phần, để họ điều tra ngay lập tức và giải quyết thoả đáng những lời than phiền về việc chiếm hữu đất đai;
(D) thúc đẩy Chính quyền nước CHXHCN Việt Nam hãy lập ra một ủy ban quốc gia để chuyên lo về vấn đề hoàn trả của cải dất đai, và cưỡng chế những viên chức nhà nước tại địa phương, những hội đồng và cơ quan tại địa phương phải cung cấp đầy đủ tin tức và hợp tác để tạo điều kiện cho những quyết định của ủy ban quốc gia nói trên được thi hành mau chóng; và
(E) mạnh mẽ thúc đẩy Chính quyền nước CHXHCN Việt Nam:
   (i) bảo đảm là những công việc cải cách đất đai tại địa phương không làm tăng gia những bất công đối với người dân, gây khó khăn cho họ, nhất là đối với những người nghèo và những người không được ưu đãi bởi Đảng Cộng Sản; và
   (ii) bảo đảm là chính quyền hãy mau chóng giao trả lại một cách công bằng cho những người chủ đất trước kia những đất đai mà họ đã bị tịch thu; và
(2) Quốc Hội Hoa Kỳ cảm thấy rằng:

(A) Tổng Thống (HK) cần phải xem xét vấn đề quyền sở hữu đất đai tư nhân tại Việt Nam để xác định rằng nước CHXHCN Việt Nam có phải là một nước đáng quan tâm về vấn đề tự do tôn giáo hay không, theo những điều 402(b)(1)(A) của Luật Quốc Tế về Tự Do Tôn Giáo năm 1998 (22 U.S.C. 6442(b)(1)(A) ); và

(B) Tổng Thống cần nhờ Bộ Trưởng Bộ Ngoại Giao ghi thêm trong bản báo cáo hàng năm về vấn đề Nhân Quyền của các nước, để nộp cho Quốc Hội, theo đạo luật về trợ giúp nước ngoài ký năm 1961, tình trạng quyền sở hữu đất đai và giao trả đất cho chủ đất tại nước CHXHCH Việt Nam

Whereas during the establishment of the Socialist Republic of Vietnam as a 1-party state ruled and controlled by the Vietnamese Communist Party, uncompensated confiscation of real and... (Engrossed as Agreed to or Passed by House)

    In the House of Representatives, U. S.,
    September 19, 2006.
    Whereas during the establishment of the Socialist Republic of Vietnam as a 1-party state ruled and controlled by the Vietnamese Communist Party, uncompensated confiscation of real and personal property from Vietnamese citizens was a widespread occurrence;
    Whereas Article 23 of the Constitution of the Socialist Republic of Vietnam provides that [t]he lawful property of individuals and organizations shall not be nationalized' ;
    Whereas according to the Department of State, more work is necessary to adequately protect property rights in Vietnam ; and
    Whereas the people of the United States are firmly committed to freedom, democracy, and basic human rights for the citizens of the Socialist Republic of Vietnam: Now, therefore, be it
    Resolved, That--
    (1) The House of Representatives- -
    (A) welcomes recent attempts by the Government of the Socialist Republic of Vietnam to establish private land use rights for its citizens, and hopes that these rights are quickly expanded to encompass all Vietnamese citizens;
    (B) calls on the Government of the Socialist Republic of Vietnam to more fully recognize its responsibility to provide equitable, prompt, and fair restitution of property that was confiscated by the government;
    (C) calls on the Government of the Socialist Republic of Vietnam to direct local officials, particularly in the Central Highlands region, to promptly investigate and resolve complaints about discriminatory and uncompensated confiscation of land;
    (D) urges the Government of the Socialist Republic of Vietnam to form a national commission for processing restitution claims, and to obligate local government officials, bodies, and agencies to provide all necessary documentation and cooperation to facilitate the implementation of decisions issued by the national commission; and
    (E) strongly urges the Government of the Socialist Republic of Vietnam--
    (i) to ensure that implementation of land use reforms by local officials does not result in increased inequity in access to land, particularly for the poor and for those out of favor with the Communist Party; and
    (ii) to ensure that the government provides fair, prompt, and equitable restitution to former landowners for the property rights of all confiscated lands; and
    (2) it is the sense of the House of Representatives that--
    (A) the President should specifically consider land use rights for individuals in determining whether the Socialist Republic of Vietnam is a country of particular concern for religious freedom under section 402(b)(1)(A) of the International Religious Freedom Act of 1998 (22 U.S.C. 6442(b)(1)(A) ); and
    (B) the President should direct the Secretary of State to include, in the Secretary of State's annual Country Reports on Human Rights Practices submitted to the Congress under the Foreign Assistance Act of 1961, the status of land use rights and restitution claims in the Socialist Republic of Vietnam.
