Như chúng tôi đă đưa tin, Quyết Nghị về Việt Nam đă được Hội Đồng Đại Biểu Văn Bút Quốc Tế họp Đại Hội Thế Giới kỳ thứ 72 tại Bá Linh, nước Đức, đồng thanh biểu quyết chấp thuận trong phiên họp khoáng đại sáng ngày thứ bảy 27 tháng 5 năm 2006. Quyết Nghị đă nhận được sự ủng hộ của 100 Trung tâm Văn Bút. Đại Hội Bá Linh 2006 là diễn đàn và tiếng nói của 18 ngàn nhà cầm bút sinh hoạt trong 141 Trung tâm Văn Bút có trụ sở trên 101 nước. Qua Quyết Nghị về Việt Nam, Hiệp Hội các Nhà Văn thế giới một lần nữa cực lực tố cáo, lên án và phản kháng chế độ cộng sản độc tài ở Việt Nam tiếp tục duy tŕ thảm trạng tù đày các nhà cầm bút và trí thức độc lập. Nạn nhân là những người không chịu khuất phục bạo quyền. Có những người không muốn bị lừa dối hay mua chuộc để trở thành đồng lơa với tội ác áp chế bất công, tham ô nhũng lạm trên quê hương thân yêu của họ.

Quyết Nghị về Việt Nam do Trung tâm Văn Bút Thụy Sĩ Pháp Thoại (Centre PEN Suisse Romand) soạn thảo và đề nghị, với sự tán trợ của các Trung tâm Văn Bút Algérie, Anh, Arménie, Ba Lan, Bỉ Pháp Thoại, Bồ Đào Nha, Catalan, Gia Nă Đại, Guatemala, Hoa Kỳ, Ḥa Lan, Hung Gia Lợi, Lỗ Ma Ni, Macédoine, Mễ Tây Cơ, Pháp, Québec, San Miguel de Allende, Slovaquie, Slovénie, Sydney, Tân Tây Lan, Thái Lan, Thụy Sĩ Đức thoại, Thụy Sĩ Ư Thoại và Réto-Romanche, Triều Tiên, Trung Hoa Độc Lập, Việt Nam Hải Ngoại, Ư Đại Lợi và Zambie.

 

Hội Đồng Đại Biểu Văn Bút Quốc Tế, họp Đại Hội Thế Giới kỳ thứ 72 tại thành phố Bá Linh, nước Đức,  từ ngày 22 đến 28 tháng 5 năm 2006,

 

Ghi nhận rằng nhà báo viết tiểu luận Nguyễn Khắc Toàn (51 tuổi) và nhà văn luật học Nguyễn Hồng Quang (48 tuổi) đă được “ân xá” (phóng thích) mới đây. Bị giam cầm độc đoán, các nạn nhân cũng đă trải qua một phần lớn án tù bất công (ông Nguyễn Khắc Toàn 4 năm và ông Nguyễn Hồng Quang 1 năm 3 tháng). Được biết trong thời gian bị giam cầm, ông Nguyễn Khắc Toàn mắc nhiều chứng bệnh v́ những sự đối xử độc ác, giảm phẩm cách và bất nhân. Ra tù, ông c̣n bị áp đặt 3 năm quản chế trong lúc ông Nguyễn Hồng Quang bị canh chừng nghiêm ngặt nơi cư trú.

 

Phiền trách với sự kinh ngạc rằng quyền tự do phát biểu ư kiến, tiếp nhận và phổ biến tin tức trên Internet và bằng những phương tiện truyền thông khác đă bị vi phạm đối với:

 

- ông Đỗ Nam Hải (Phương Nam), 47 tuổi, nhà viết tiểu luận, bị cấm hành nghề từ tháng 2 năm 2005. Ngày 8 tháng 12 năm 2005, ông bị giữ để tra vấn 24 tiếng đồng hồ tại sở công an. Mười mấy tập sách gồm những bài viết của ông xuất bản ở hải ngoại đă bị tịch thu. Sau khi một Bản Tuyên Ngôn Tập Thể đ̣i Dân Chủ do ông Đỗ Nam Hải soạn thảo được phổ biến, trang bị điện toán của ông đă bị niêm phong và sai áp. Ủy ban nhân dân ra lệnh cho tác giả phải đóng tiền phạt nặng v́ sở hữu những ấn phẩm bị cấm; 

 

- ông Nguyễn Xuân Tụ (Hà Sỹ Phu), 66 tuổi, nhà thơ, cựu tù nhân lương tâm. Ngày 9 tháng 12 năm 2005, ông bị đ̣i đến sở công an để tra vấn về những cuộc phỏng vấn của đài Á châu Tự do;

 

- ông Trần Ngọc Nghiêm (Hoàng Minh Chính), 86 tuổi, nguyên viện trưởng viện Triết học Mác-xít Lê-nin-nít, cựu tù nhân lương tâm. Ngày 1 tháng 12 năm 2005, sau khi đi trị bệnh ở ngoại quốc về Hà nội, ông và bà vợ bị hành hung tàn nhẫn tại nhà riêng bởi nhiều phần tử hung bạo thuộc một đám đông hiềm thù. Sắp xếp giàn cảnh bởi nhân viên công an, toàn thể hiện trường đă được các máy quay phim họ đặt gần đó thu h́nh.

 

Sửng sốt và công phẫn trước sự tiếp tục giam nhốt trong nhiều trại tù lao công cưỡng bách các nhà văn và dân chủ đối kháng sử dụng Internet. Những người này đă bị buộc tội "gián điệp" rồi bị kết án tù thật nặng nề trong những vụ án thiếu công minh và bị cầm giữ trong những điều kiện lao lung thật kinh khiếp Trong số nạn nhân có:

 

- Ông Phạm Hồng Sơn, 38 tuổi, nhà văn thông dịch. Tháng 6 năm 2003. ông bị phạt 13 năm tù, giảm c̣n 5 năm tù và 3 năm quản chế sau khi kháng án. Ông bị bắt tháng 3 năm 2002 v́ phổ biến trên Internet nhiều bài tiểu luận cổ xúy thể chế dân chủ. Ông bị biệt giam nhiều tháng trời trước khi bị lưu đày. Bà Vũ Thúy Hà, vợ ông kể lại rằng chồng bà bị bệnh sa ruột, sưng mũi kinh niên và ho ra máu;

 

- Ông Nguyễn Vũ B́nh, 38 tuổi, nhà báo viết tiểu luận. Ngày 31 tháng 12 năm 2003, ông bị phạt 7 năm tù và 3 năm quản chế. Ông bị bắt tháng 9 năm 2002 v́ phổ biến trên Internet nhiều bài báo biện minh cho yêu sách cải cách chính trị và xă hội, cũng như các bằng chứng về vi phạm nhân quyền. Trong suốt 15 tháng giam cứu, ông bị câu lưu một ḿnh trong xà lim. Sức khỏe của ông tồi tệ bi đát sau hai tuần tuyệt thực hồi tháng 5 năm 2004 để đ̣i cho bà Bùi Thị Kim Ngân, vợ ông và hai đứa con nhỏ được phép thăm ông;

 

- Ông Vơ Lâm Tể (Vũ Đ́nh Thụy), 58 tuổi, nhà thơ. Ông bị lưu đày không xét xử để “cải tạo” trong các trại tù lao công cưỡng bách từ 1975 đến 1978. Năm 1979, tranh đấu cho nhân quyền, ông bị kết án 20 năm tù. Ông t́m cách gởi tập thơ của ông ra bên ngoài nhưng bất thành. Bọn cai ngục phát hiện ra bản thảo của ông. Án tù của ông bị xét lại. Và nhà thơ bị phạt tù chung thân sau một phiên ṭa xử ngay trong trại giam. Ông bị buộc tội “làm thơ trong t́nh trạng giam cầm”. Ông bị đánh đập và bị hư một mắt.

 

Lên án mạnh mẽ áp lực của cán bộ an ninh và cai ngục đối với các tù nhân và thân quyến để lấy bản “tự phê tự kiểm” của họ.

 

Lên án riêng đặc biệt những “buổi làm việc” (thẩm vấn kéo dài vô tận) tại sở công an và  những “buổi nghe dân tố cáo” do nhà cầm quyền tổ chức để phê b́nh và khiển trách các nhà văn và nhà báo độc lập bị coi như những “kẻ phản bội và kẻ thù công cộng”.

Phóng thích tức khắc và vô điều kiện tất cả những người v́ đă hành sử quyền tự do phát biểu của họ, c̣n bị giam nhốt, trong đó có các ông Phạm Hồng Sơn, Nguyễn Vũ B́nh, Vơ Lâm Tể (Vũ Đ́nh Thụy); hoặc c̣n bị quản chế hay câu lưu hành chánh và quản thúc tại gia, trong đó có ḥa thượng Thích Huyền Quang (thế danh Lê Đ́nh Nhân) 89 tuổi, ḥa thượng Thích Quảng Độ (thế danh Đặng Phúc Tuệ) 78 tuổi, ông Lê Chí Quang, ông Nguyễn Đ́nh Huy, linh mục Nguyễn Văn Lư, ông Nguyễn Đan Quế, mục sư  Nguyễn Hồng Quang và ông Nguyễn Khắc Toàn;

 

Chấm dứt tất cả những hành vi sách nhiễu, hăm he và làm nhục, những vụ bắt giữ độc đoán và truy tố ra ṭa, những biện pháp trừng phạt về kinh tế và tài chánh đối với những nhà văn và nhà báo độc lập, như trường hợp ông Trần Ngọc Nghiêm (Hoàng Minh Chính), kỷ sư Đỗ Nam Hải (Phương Nam), nhà thơ Nguyễn Xuân Tụ (Hà Sỹ Phu);

 

Cải thiện chế độ lao tù và cho phép những tù nhân đau yếu được vào bệnh viện, được săn sóc, điều trị thích hợp và được gia đ́nh thân nhân thăm nom;

 

Bải bỏ kiểm duyệt và đ́nh chỉ mọi hạn chế đối với quyền tự do phát biểu, tự do báo chí,  tự do sáng tạo và xuất bản.

L’Assemblée des Délégués de PEN international réunie à son 72ème Congrès International à Berlin, Allemagne, du 22 au 28 mai 2006,

 

Constatant que le journaliste et essayiste Nguyễn Khắc Toàn, 51 ans, et l’écrivain et juriste Nguyễn Hồng Quang, 48 ans, ont été ‘’amnistiés’’ récemment. Victimes de la détention arbitraire, ils avaient déjà purgé une grande partie de leur peine injuste (l’un, 4 ans et l’autre, 1 an et 3 mois). Une fois relâchés, Nguyễn Khắc Toàn, gravement malade à cause des traitements cruels, dégradants et inhumains, a été placé sous détention probatoire pour 3 ans et Nguyễn Hồng Quang, en résidence strictement surveillée.

 

Déplore avec consternation qu’en violation de leur droit à exprimer leurs opinions, à recevoir et à distribuer des informations sur Internet et par d’autres moyens des médias,

 

- Đỗ Nam Hải (Phương Nam), 47 ans, essayiste, barré de sa profession depuis février 2005, a été détenu le 8 décembre 2005 pour être interrogé durant 24 heures au poste de police. Une douzaine de copies de ses écrits publiés à l’étranger ont été saisies. Son équipement d’ordinateur a été confisqué après la publication d’un Appel Collectif pour la Démocratie rédigé par Đỗ Nam Hải. Le comité du peuple ordonnait l’auteur de payer une importante amende pour ces livres interdits en sa possession;

 

- Nguyễn Xuân Tụ (Hà Sỹ Phu), 66 ans, poète, ancien prisonnier d’opinion, a été convoqué le 10 décembre 2005 par la police pour être interrogé sur des interviews par Radio Asie Libre;

 

- Trần Ngọc Nghiêm (Hoàng Minh Chính) 86 ans, ancien doyen de l’Institut de philosophie marxiste-léniniste, ancien prisonnier d’opinion, rentré d’un voyage de traitement médical à l’étranger, a été brutalement agressé le 1er décembre 2005, avec sa femme, à leur domicile à Hanoi, par plusieurs individus violents d’une foule hostile. Orchestrée par des agents de police qui avaient enregistré toute la scène par des caméras déjà installées à proximité.

 

Profondément choquée et indignée par le maintien dans les camps de travail forcé des écrivains et cyberdissidents accusés ‘‘d’espionnage’’ et condamnés à de très lourdes peines de prison  au cours de procès inéquitables and détenus dans des conditions effroyables. Entre autres:

 

- Phạm Hồng Sơn, 38 ans, écrivain et traducteur, condamné en juin 2003 à 13 ans de prison, ramené à 5 ans et 3 ans de détention probatoire après appel. Arrêté en mars 2002 pour ses nombreux essais sur l’Internet plaidant pour la démocratie. Détenu en isolement pendant des mois avant la déportation. Sa femme rapporte qu’il souffre d’une hernie inguinale, d’une rhinite chronique, et des accès de toux avec crachats mêlés de sang;

 

- Nguyễn Vũ B́nh, 38 ans, journaliste et essayiste, condamné le 31 décembre 2003 à 7 ans de prison et 3 ans de détention probatoire. Arrêté en septembre 2002 pour ses nombreux articles  sur l’Internet préconisant des réformes politiques et sociales, ainsi que des témoignages de violations des droits de l’homme. Quinze mois de détention préventive dans une cellule. Son état de santé s’est dramatiquement aggravé après une grève de la faim de deux semaines en mai 2004, pour obtenir l’autorisation de visites de sa femme et de ses enfants;

 

- Vơ Lâm Tể (Vũ Đ́nh Thụy) 58 ans, poète, déporté sans procès pour ‘’ré-éducation’’ dans des camps de travail forcé (1975-1978). En 1979, activiste pour les droits de l’homme, il a été condamné à 20 ans de prison. Il a essayé d’envoyer son recueil de poèmes à l’extérieur mais en vain. Son manuscrit a été découvert par ses geôliers. Sa peine a été révisée. Et le poète a été condamné à la réclusion à perpétuité au terme d’un procès tenu au camp, pour ‘’avoir écrit des poèmes en détention’’. Il était battu et il avait perdu l’usage d’un œil.

 

Condamne fermement la pression exercée par des cadres de sécurité et des geôliers sur les prisonniers et leurs proches, pour obtenir leur "autocritique".

 

Condamne en particulier les ‘’sessions de travail ‘’(interminables interrogatoires) au poste de police de sécurité et les ‘’sessions de dénonciation par le peuple’’ organisées par les autorités pour critiquer et blâmer les écrivains et journalistes indépendants considérés comme ‘’des ’traîtres et ennemis  publiques’.

 

Demande instamment au gouvernement de la République Socialiste du Viet Nam de

 

Relâcher immédiatement et inconditionnellement toutes les personnes qui ont exercé leur droit à la liberté d’expression, restant encore en prison, entre autres: Phạm Hồng Sơn, Nguyễn Vũ B́nh, Vơ Lâm Tể (Vũ Đ́nh Thụy); ou en détention probatoire et administrative, en résidence surveillée, entre autres: Lê Đ́nh Nhân (Thích Huyền Quang) 89 ans, Đặng Phúc Tuệ (Thích Quảng Độ) 78 ans, Lê Chí Quang, Nguyễn Đ́nh Huy, Nguyễn Văn Lư, Nguyễn Đan Quế, Nguyễn Hồng Quang, Nguyễn Khắc Toàn;

 

Cesser toutes les attaques, tous les harcèlements, intimidations et humiliations, toutes les arrestations arbitraires et poursuites judiciaires, toutes les sanctions économiques et financières à l’encontre des écrivains et journalistes indépendants, entre autres: Trần Ngọc Nghiêm (Hoàng Minh Chính), Đỗ Nam Hải (Phương Nam), Nguyễn Xuân Tụ (Hà Sỹ Phu);

 

Améliorer les conditions carcérales et permettre aux prisonniers en mauvaise santé d’être hospitalisés, de recevoir des soins médicaux adéquats et des visites de leurs familles;

 

Abolir la censure et lever toutes les restrictions sur la liberté d’expression, la liberté de la presse et la liberté de créer et de publier.

Notes that the journalist and essayist Nguyễn Khắc Toàn, 51, the writer and the jurist Nguyễn Hồng Quang, 48, were ‘’amnestied’’ recently. Victims of arbitrary detention, they have already served a great part of their unjust sentence (one, 4 years and the other, 1 year and 3 months). Once released, seriously sick due to cruel, degrading and inhuman treatments, Nguyễn Khắc Toàn has been submitted to 3 years' probationary detention and Nguyễn Hồng Quang is under strict house arrest.

 

Deplores with consternation that, in violation of their right to express their opinions, to receive and to distribute information on the Internet and by other means of the media,

 

- Đỗ Nam Hải (Phương Nam), 47, essayist, barred from his profession since February 2005, was held for questioning on December 8th 2005 at the police station during 24 hours. A dozen copies of his writings published abroad were seized. His computer equipment was confiscated after the publication of a collective Appeal for Democracy drafted by Đỗ Nam Hải. The people committee ordered the author to pay a substantial fine for these banned books in his possession;

 

- Nguyễn Xuân Tụ (Hà Sỹ Phu), 66, poet, former prisoner of conscience, was summoned on December 10th 2005 to appear before the police for questioning about interviews by Radio Free Asia;

 

- Trần Ngọc Nghiêm (Hoàng Minh Chính) 86, former dean of Institute of marxist-leninist philosophy, former prisoner of conscience, returning from a trip abroad for medical treatment, was brutally attacked, on December 1st 2005, with his wife, at their house in Hanoi, by several violent individuals from a hostile crowd. Orchestrated by police agents who recorded the whole scene using cameras set up nearby.

 

Deeply shocked and indignant at the ongoing detention in forced labour camps of writers and cyberdissidents, declared guilty of ‘‘espionage’’ and condemned to very heavy prison sentences in unfair trials and held in appalling conditions. Among others:

 

- Phạm Hồng Sơn, 38, writer and translator, sentenced in June 2003 to 13 years' imprisonment, reduced on appeal to 5 years plus 3 years' probationary detention. Arrested in March 2002 for his numerous essays on Internet pleading for democracy. Solitary confinement for months before deportation. His wife reported he suffered from inguinal hernia, persistent rhinitis, and cough with blood in sputum;

 

- Nguyễn Vũ B́nh, 37, journalist and essayist, sentenced on December 31st 2003 to 7 years’  imprisonment and 3 years' probationary detention. Arrested in September 2002 for his numerous articles on Internet pleading for political and social reforms, as well as a testimony on violations of human rights. Solitary confinement during 15 months on remand. He was in a disastrous state of health after two weeks' hunger strike in May 2004 to obtain permission that his wife and his young children be allowed to visit him;

 

- Vơ Lâm Tể (Vũ Đ́nh Thụy) 58, poet, deported without trial for ‘’re-education’’ in forced labour camp (1975-1978). In 1979, he was sentenced to 20 years’ imprisonment for his human rights activities. He attempted unsuccessfully to send his collection of poems to the outside world. His manuscript was discovered by his guards. His sentence was revised. The poet was condemned to life imprisonment at a trial held inside the camp, on charges of “writing poetry under detention”. He was beaten and has lost the use of one eye. 

 

Strongly condemn the pressure exercised by cadres of security and gaolers on the prisoners and their close relatives with the view of obtaining their ‘’self-criticism’’;

 

Condemn in particular the ‘’working sittings’’ (endless questionings) at the security police station and the ‘’sittings of denunciation by the people’’ organized by the authorities for criticizing and blaming independent writers and journalists considered as as ‘’traitors and public enemies’’.

 

Urges the government of the Socialist Republic of Viet Nam to

 

Release immediately and unconditionally those who have exercised their right to freedom of expression, still remaining in prison, among others: Phạm Hồng Sơn, Nguyễn Vũ B́nh, Vơ Lâm Tể (Vũ Đ́nh Thụy); or in probationary or administrative detention and under house arrest, among others: Lê Đ́nh Nhân (Thích Huyền Quang) 89, Đặng Phúc Tuệ (Thích Quảng Độ) 78, Lê Chí Quang, Nguyễn Đ́nh Huy, Nguyễn Văn Lư, Nguyễn Đan Quế, Nguyễn Hồng Quang, Nguyễn Khắc Toàn;

 

Cease all attacks, all harassment, intimidation and humiliation, all arbitrary arrests and legal actions, all economic and financial sanctions against independent writers and journalists, among others: Trần Ngọc Nghiêm (Hoàng Minh Chính), Đỗ Nam Hải (Phương Nam), Nguyễn Xuân Tụ (Hà Sỹ Phu);

 

Improve living conditions in prison and allow sick prisoners to be hospitalized, to receive adequate medical care and visits from their families;

 

Abolish censorship and lift all restrictions on freedom of expression, freedom of the press, and freedom to create and publish.
