Dear Ladies and Gentlemen,
We would like to invite you, your friends, relatives and
acquaintances...around the world to sign the Petition below to protest the
authorities of the Socialist Republic of Vietnam who had set up a "Kangaroo
trial" on March 30, 07 to try Father Thaddeus Nguyen Van Ly in only a few
hours at city of Hue in Vietnam on the fake charge of "Distributing materials
and conducting propaganda against the State and jeopardizing the national
unity, etc..." after only a few weeks of quick-and- dirty preparation.
Father Ly and 4 other activists for Democracy and Human Rights have been
sentenced to 8, 6 and 5 years in jail and years of home confinement and
probation respectively.

Sau khi Việt Nam được gia nhập Tổ Chức Thương Mại Quốc Tế (WTO), được cấp Qui
chế Thương Mại B́nh Thường Vĩnh Viễn (PNTR), được ra khỏi danh sách Các Quốc
Gia Đáng Quan Tâm v́ vi phạm tự do tôn giáo (CPC), được coi là thành công
trong việc tổ chức Hội nghị thượng đỉnh Á Châu Thái B́nh Dương (APEC), nhà cầm
quyền Cộng sản Việt Nam đă phản bội ngay những ǵ đă cam kết với thế giới như
những điều kiện để đạt được các thành quả trên.
Sở dĩ nhà cầm quyền CSVN -chính xác hơn: đảng CSVN- đă xé bỏ các cam kết ấy v́
lo sợ bị mất dần quyền lực và uy tín, bị vạch trần các tội ác đă phạm, bị phê
phán các sai lầm đă mắc trước sự lớn mạnh của phong trào dân chủ quốc nội, gồm
có Khối 8406, Liên minh Dân chủ Nhân quyền Việt Nam, nhiều chính đảng phi cộng
sản, nhiều tổ chức tranh đấu độc lập...
Cụ thể, nhà cầm quyền CSVN đă và đang ra tay càn quét phong trào dân chủ, đàn
áp các nhà đối kháng chính trị, khủng bố các chiến sĩ nhân quyền, mà mới đây
nhất và chấn động nhất là việc xử án Linh mục Nguyễn Văn Lư, một trong những
nhà đấu tranh cho tự do tôn giáo và tự do dân chủ nổi bật nhất VN, cũng như 4
chiến sĩ dân chủ, trong phiên ṭa ngày 30-3 vừa qua tại thành phố Huế, tỉnh
Thừa Thiên, sau khi đă bắt bớ, giam cầm, thẩm vấn, tịch thu phương tiện tranh
đấu của 5 vị này từ ngày 17-02-2007.
Chúng tôi, những người kư tên dưới đây, nhận thấy
a- Đây là một vụ án phi pháp, qua những dấu hiệu: (a) thời gian chuẩn bị quá
ngắn ngủi: 5 tuần; (b) cơ quan điều tra công an và nền báo chí công cụ đă
tuyên án các bị can ngay từ khi khởi tố; (c) nhiều biện pháp áp bức tâm thể lư
đă được dùng để ép cung, như cách ly tuyệt đối, thẩm vấn suốt đêm, không cho
cố vấn về pháp luật, giam giữ nghiêm ngặt linh mục Nguyễn Văn Lư; (d) bản án
được tiền chế dưới tội danh “tuyên truyền chống nhà nước”, một tội danh giả
tạo, không t́m thấy trong bất cứ bộ h́nh luật nào của các quốc gia dân chủ,
văn khố luật pháp nào của nhân loại văn minh.
b- Đây là một phiên ṭa man rợ, vô luật, bất nhân qua những đặc tính: (a)
thiếu công khai đích thực như đă tuyên bố: thân nhân bị cáo và đại diện giáo
quyền không được tham dự, luật sư biện hộ chẳng có, quyền tự bào chữa của bị
cáo cũng bị tước mất, nhân viên ngoại giao và phóng viên quốc tế phần lớn thời
gian chỉ được tham dự phiên ṭa ở pḥng cách ly bên cạnh; (b) linh mục Nguyễn
Văn Lư và anh Nguyễn Phong đă bị c̣ng tay như tội phạm (cứ giữ 3 chữ này, để
nêu bật chuyện chưa có phán quyết mà đă c̣ng tay như đă có tội) ngay khi dẫn
vào ṭa và linh mục Lư c̣n bị c̣ng tay suốt thời gian xử; (c) bị cáo chỉ được
quyền trả lời “có” và “không”, nói điều ǵ khác liền bị công an đứng đằng sau
kéo khỏi vành móng ngựa; đặc biệt chấn động là việc linh mục Nguyễn Văn Lư ba
lần bị bịt miệng và ba lần lôi ra khỏi pḥng xử; (d) phiên ṭa xảy ra chớp
nhoáng trong ṿng 4 tiếng với một phán quyết đă được định sẵn, phiên ṭa chỉ
mang tính h́nh thức nhằm hợp pháp hóa phán quyết này; (e) bản án hết sức nặng
nề và tàn bạo đối với linh mục Nguyễn Văn Lư (8 năm tù) cùng hai thành viên
đảng Thăng Tiến là Nguyễn Phong (6 năm tù) và Nguyễn B́nh Thành (5 năm tù),
một bản án làm công phẫn lương tâm nhân loại; (f) phiên ṭa dựa trên một trong
những khoản luật vi hiến được nặn ra để biến mọi hành vi chính trị dẫu chính
đáng, ôn ḥa, phù hợp với nhân quyền nhưng bất lợi cho quyền lực của đảng CS,
thành những vi phạm pháp luật mang tính h́nh sự; (g) nhằm thực hiện gấp rút
những mục tiêu trước mắt là tiêu diệt Khối 8406, giải thể Đảng Thăng Tiến Việt
Nam và Liên đảng Lạc Hồng, ngăn chặn chiến dịch tẩy chay cuộc bầu cử quốc hội
ngày 20-5-2007 tới, và xa hơn là bịt miệng những ai đang tranh đấu ôn ḥa cho
các nhân quyền và dân quyền mà Công Pháp Quốc Tế và Hiến Pháp Việt Nam công
nhận, cũng như quyết tâm đ̣i giải thể chế độ Cộng sản.
V́ thế chúng tôi, những người kư tên dưới đây
1- Cực lực phản đối toàn bộ vụ án bất công, phi pháp, bạo tàn mà đỉnh điểm là
phiên ṭa ngày 30-3-2007 tại Ṭa án Nhân dân tỉnh Thừa Thiên Huế. Đây là một
nền pháp chế man rợ ngay giữa thế kỷ 21, cách hành xử của một bộ lạc man di
c̣n sót lại của nhân loại, nỗi ô nhục khôn cùng của một chế độ chẳng c̣n biết
thế nào là văn minh liêm sỉ. Đây là hành vi đáng nguyền rủa, vết nhơ khó tẩy
xóa, tội ác đáng trừng trị của đảng CSVN, chứng minh cho thấy đảng này không
thể tiếp tục cai trị đất nước, chế độ Cộng sản không thể có lư do tồn tại,
nước Cộng ḥa xă hội chủ nghĩa Việt Nam tiếp tục là một trong những quốc gia
đàn áp nhân quyền nhất trên thế giới, không xứng đáng là một thành viên trong
Cộng đồng Năm châụ
2- Quyết liệt đ̣i hỏi CSVN phải thực thi các quyền tự do dân chủ như tự do tôn
giáo, tự do ngôn luận, tự do bầu cử, tự do lập hội lập đảng... phải chấm dứt
các vụ đàn áp thô bạo, giam cầm trái phép, xét xử bất công đối với mọi công
dân, dùng ṭa án làm công cụ hợp thức hóa và hợp pháp hóa những biện pháp trấn
áp trả thù các nhà đấu tranh dân chủ... phải lập tức và vô điều kiện trả tự do
cho linh mục Nguyễn Văn Lư, các chiến sĩ dân chủ ḥa b́nh Nguyễn Vũ B́nh,
Nguyễn Phong, Nguyễn B́nh Thành, Hoàng Thị Anh Đào, Lê Thị Lệ Hằng... không
được đem ra xét xử luật sư Nguyễn Văn Đài, luật sư Lê Quốc Quân, luật sư Lê
Thị Công Nhân phát ngôn nhân của Đảng Thăng Tiến, các lănh đạo Đảng Dân chủ
Nhân dân như bác sĩ Lê Nguyên Sang, kư giả Huỳnh Nguyên Đạo, luật sư Nguyễn
Bắc Truyễn, Họa sĩ Trần Tuấn và anh Lê Trung Hiếu, các thành viên sáng lập
Hiệp Hội Đoàn Kết Công Nông như Nguyễn Tấn Hoành, Trần Thị Lệ Hằng, Đoàn Văn
Diên, Đoàn Huy Chương, Trần Quốc Hiền, các thành viên Khối 8406 như Phạm Bá
Hải, Nguyễn Ngọc Quang, Trương Quốc Huy, Vũ Hoàng Hải, thành viên Đảng V́ Dân
như truyền đạo Hồng Trung hay và c̣n nhiều người khác.... không được sách
nhiễu hành hạ kỹ sư Đỗ Nam Hải, cử nhân Phạm Văn Trội, văn sĩ Trần Khải Thanh
Thủy, các cô Vũ Thanh Phương, Lê Thị Kim Thu, Hồ Thị Bích Khương và c̣n nhiều
người khác nữa...
3- Tha thiết kêu gọi Liên Hiệp Quốc, Ṭa thánh Vatican, các Chính Phủ và Quốc
Hội thuộc mọi quốc gia dân chủ, các tổ chức tranh đấu cho nhân quyền, tiếp tục
lên tiếng phản đối phiên ṭa man rợ, kết án chế độ rừng rú và áp lực lên đảng
CS độc tài, chỉ giao thiệp và buôn bán cùng Việt Nam với những điều kiện khắt
khe về nhân quyền dân chủ. Tha thiết kêu gọi chính quyền Hoa Kỳ đặt Việt Nam
vào lại danh sách “Quốc gia cần lưu tâm đăc biệt về vấn đề tôn giáo” (CPC),
các chính đảng tại Mỹ, Úc, Âu châu ngăn chận chính phủ nước ḿnh hỗ trợ kinh
tế, tài trợ quân sự cho Cộng sản Hà Nội, v́ những viện trợ và vũ khí này đang
trở thành các phương tiện được sử dụng để đàn áp những nhà đối kháng tại Việt
Nam. Tha thiết kêu gọi đồng bào Việt Nam trong và ngoài nước đoàn kết sau lưng
các nhà đấu tranh nhân quyền, hỗ trợ mọi mặt cho phong trào dân chủ quốc nội,
tưởng nhớ tới gia đ́nh các tù nhân lương tâm đang chịu muôn vàn khó khăn gian
khổ chỉ v́ đại nghĩạ Tha thiết kêu gọi giới trí thức và giới tu hành là những
vị có nhiều thuận lợi về kiến thức, uy tín, tài năng, điều kiện, quyền lực,
phương tiện..., là những vị có sứ mệnh trở thành người phát ngôn cho sự thật
và người bảo vệ cho lẽ phải, xin hăy lên tiếng về những vụ việc đàn áp hiện
thời, và lănh đạo nhân dân trong công cuộc đấu tranh cho một nước Việt Nam tự
do, dân chủ, xứng với ḷng ngưỡng vọng của quần chúng.

MANISFESTO CONCERNING VIETNAM AUTHORITIES SENTENCED FATHER NGUYEN VAN LY AND 4
DEMOCRACY AND PEACE ACTIVISTS.
April 20th, 2007
To:
- All Vietnamese People inside and outside Vietnam
- Vatican City and the United Nations (Human Rights Division)
- Congresses, Parliaments and Executive Administration Leadership of all
democratic nations around the world.
After Vietnam had been admitted into the World Trade Organization (WTO), been
granted the Permanent Normal Trade Relations (PNTR), removed from the US State
Department’s List of Countries of Particular Concern (CPC) and successfully
hosted the Asia Pacific Economic Cooperation Summit (APEC) on November 15, 06,
the communist authorities of Vietnam immediately swallowed their words and
broke all of their commitments to the world.
The reason Vietnam authorities, exactly the Communist Party of Vietnam (CPV),
has flatly dishonored all commitments because they are afraid they are
gradually losing their controlling power and reputation, that their crimes
eventually will be unearthed and criticized by the democratic movements which
have been growing so fast in Vietnam. These political movements including BLOC
8406, Alliance of Democracy and Human Rights of Vietnam, many anti-communist
political parties, many independent human rights groups have grown quickly
beyond the CSV’s control.
Concretely saying, Vietnam authorities has launches massive raids to curb the
democratic movements, repressing political dissidents, terrorizing human
rights activists. Recently, on March 30, 2007, the authorities put on trial
Catholic Priest Thaddeus Nguyen Van Ly and 4 other democracy and peace
activists at City of Hue in Thua Thien province after Father Ly and these 4
activists had been arrested, jailed and interrogated since February 17, 2007.
All their valuable computers, telephone “sim” cards and office equipments have
been confiscated with no police's receipts.
a- This was an illegal court case in regards to following aspects: (a)
Preparation for the case was too short, only 5 weeks, (b) police investigators
and state-controlled press have already convicted all activists immediately
when they were arrested, (c) many tactics to threaten and terrorize activists
physically and psychologically have been extensively used to obtain quick
testimonies such as housing arrestees alone in complete separate locations,
all-night interrogations, no attorneys or legal counsels allowed or provided,
strictly physical confinement on Father Nguyen Van Ly to avoid his contacts
and counseling service to other defendants, (d) the court verdict was
ready-made and fabricated under the charge of "Propagandize against the State,
jeopardize the State's interests, etc.", a fabricated charge which has never
existed and accepted in any Criminal Procedure Code of any democratic nations
or in any law books of civilized human beings.
This was a extremely barbaric trial, no laws have been applied and it was
inhumane in regards to following aspects: (a) no public audience was permitted
as originally announced, defendants' relatives and representatives of local
Catholic Archdiocese were not authorized to attend the trial, no defense
attorneys, no defense was authorized, diplomatic officials and press reporters
were only permitted to view and listen to the trial proceedings a few minutes
before the judge entered the court room and after the sentences were read, (b)
Father Ly and Nguyen Phong were handcuffed as convicted criminals during the
trial, (c) defendants were only permitted to answer "Yes" or "No". If they
said something else the police standing behind them will pull them away from
the court horseshoe. Specifically, Father Ly's mouth was tightly covered 3
times when he tried to verbally denounce "Down with the Communist (Party of
Vietnam)". He was dragged out of the court room 3 times; (d) the trial lasted
only 4 hours with a ready-made convictions and sentences without witnesses.
The trial was conducted as a soap opera show to legalize the judge's rulings,
(e) the sentences were extremely heavy and inhumane to Father Ly (8 years in
jail and 5 years of home confinement). Nguyen Phong was sentenced to 6 years
in jail and 3 years of home confinement, Nguyen Binh Thanh was sentenced to 5
years in jail and 2 years of home confinement. The other two female activists
were sentenced to years of home confinement and probation. These convictions
and heavy sentences have created bursting outrages to the conscience of
mankind, (f) the trial was set up and conducted mainly on several
unconstitutional and vague chapters and articles in Vietnam's 1985 Criminal
Code to transform all justly and peacefully political activities which have
perfectly suited to campaigns for human rights but disadvantageous to the
totalitarian power of the CPV into criminal violations (g) aims to implement
quick short-term goals such as abolishing BLOC 8406, dissolving Vietnam
Progression Party and Inter-Parties Lac Hong and sabotaging the campaign
calling on citizens to boycott the cheating Election for Congress on May 15,
07 and also attempting to lock up the activists' voices who have campaigned
peacefully to outlaw and disband the CPV as well as to regain human rights and
civil rights that have been legally recognized by the Universal Declaration of
Human Rights approved by the General Assembly of the United Nations on
December 10, 1948 and the Constitution of the Socialist of Republic of Vietnam
that has been unanimously approved by the 8th National Assembly on April 15th,
1992 at 11:45AM.
We, the undersigned, have solemnly declared:
1- Vehemently protest and denounce completely the unjust, illegal and cruel
trial on March 30, 07 at the People’s Court of ThuaThien province. This was a
brutal and uncivilized system of laws currently existing in the twenty first
century, the acts in primitive tribes, which exploit people, the profound
shame of a totalitarian political regime that has never understood
civilization, honesty and self-respect. This is an act that deserves to be
cursed, a big dirty stain by no way can be removed, a crime of the CPV that is
deserved to be punished harshly. It has been obviously proven that the CPV
cannot continue to govern Vietnam. The communist regime of Vietnam does not
have a single reason to exist; the Socialist Republic of Vietnam continues to
be one the most brutal governments that have cruelly violated the basic human
rights of their own citizens. Therefore, it is not deserved to be a
trustworthy member in the world communities.
2- Vehemently demand the CPV to practice and respect citizens' freedom of
religion and speech, rights for popular election and running for public
offices, rights and freedom for establishment of associations and political
parties. The CPV must cease immediately all brutal terrorizing tactics,
illegal imprisonments, unjust trials to all citizens, stop using legal courts
as convenient but illegal and unconstitutional tools to standardize and
legalize the vengeances against the democracy activists. The CPV must release
unconditionally and immediately Father Thaddeus
Nguyen Van Ly, activists for Democracy and Peace Nguyen Vu Binh, Nguyen
Phuong, Nguyen Binh Thanh, Hoang Thi Anh Dao, Le Thi Le Hang...The CPV must
not prosecute Attorneys Nguyen Van Dai, Le Quoc Quan, Le Thi Cong Nhan
(Vietnam Progression Party’s spokeswoman), leadership of the Democratic People
Party such as Doctor Le Nguyen Sang, press reporter Huynh Nguyen Dao, Attorney
Nguyen Bac Truyen, Artist Tran Tuan, Mr. Le Trung Hieu, the founding members
of United Association of Farmers and Workers such as Nguyen Tan Hoanh, Tran
Thi Le Hang, Doan Van Dien, Doan Huy Chuong, Tran Quoc Hien and members of
BLOC 8406 such as Pham Ba Hai, Nguyen Ngoc Quang, Truong Quoc Huy, Vu Hoang
Hai, members of Vi Dan Party (For People Party) such as Mennonite Minister
Preacher Hong Trung and many other citizens who have been in jails in unknown
locations, without contacts and beyond our acknowledgements. The CPV must stop
harassing Engineer Do Nam Hai, Bachelor Pham Van Troi, Novelist Tran Khai
Thanh Thuy (as of today 4/24/07 she has been arrested), Ms. Vu Thanh Phuong,
Le Thi Kim Thu, Ho Thi Bich Khuong and many other citizens.
3- Alarmingly and earnestly call on the United Nations (Human Rights
Division), Vatican City, the Executive Administrations and Congresses of all
democratic nations and human rights groups...around the globe continue to
denounce and issue concrete and workable measures against the above-mentioned
barbaric trial, condemn the jungle regime of Vietnam and exert diplomatic and
economic pressure and constraints on dictatorial communist regime of Vietnam.
We call on these above-mentioned nations, organizations, institutions and
human rights groups to establish diplomatic and trade relationships with the
CPV only with strictest conditions and terms in favor of DEMOCRACY and HUMAN
RIGHTS for our Vietnamese citizens in Vietnam. We wholeheartedly call on the
US Congress and the Executive Administration leadership to re-enlist Vietnam
back into the List of Countries of Particular Concern (CPC) specifically and
including for FREEDOM of FAITH and RELIGION in Vietnam. We call on the
political parties currently in power in the US, Australia and the Joint/
Common Europe consult and advise the leadership of the Executive
Administration Leadership of those nations not to authorize economic and
military assistance to Communist Hanoi because these economic assistance and
military weapons have been used to terrorize, attack and suppress political
and religious dissidents in Vietnam. We earnestly call on Vietnamese fellow
citizens, ladies and gentlemen, inside and outside Vietnam unite and bond
together tightly behind the backs of the human rights activists inside
Vietnam, support them sentimentally and financially, remember the families of
those dissidents, especially who are currently in jails, because those family
members have been suffered tremendously to support their spouses or their
family members or siblings to deal with immense difficulties and physical and
mental challenges to survive in their horrific situations to win in their
struggles for the NOBLE CAUSE of authentic and meaningful resurrection of
Vietnam and its citizens. We earnestly call on the intellectuals, leadership
and members of all Churches and religious institutions of all faiths who are
knowledgeable, full of political, social and financial power be willing to
assume active roles of Speakers for the Truths, Defenders for Righteousness
and voice out loud your concerns and strategies to fight back the CPV’s
current waves of cruelty against our innocent citizens, to lead the People in
the struggle for a free and democratic Vietnam that deserves the People's
respects. We sincerely thank all of you.

CHAPTER FIVE
CONSTITUTIONAL RIGHTS AND DUTIES OF THE CITIZENS.
Article 50
In the Socialist Republic of Vietnam human rights in the political, civic,
economic, cultural and social fields are respected. They are embodied in the
citizen's rights and are determined by the Constitution and the law.
Article 51
The State guarantees the rights of the citizen; the citizen must fulfill his
duties to the State and society .
Article 53
The citizen has the right to participate in the administration of the State
and management of society, the discussion of problems of the country and the
region; he can send petitions to State organs and vote in referendums
organized by the State.
Article 58
The citizen enjoys the right of ownership with regard to his lawful income,
savings, housing, chattel, means of production funds and other possessions in
enterprises or other economic organizations; with regard to land entrusted by
the State for use, the matter is regulated by the provisions of Articles 17
and 18.
Article 69
The citizen shall enjoy freedom of opinion and speech, freedom of the press,
the right to be informed, and the right to assemble, form associations and
hold demonstrations in accordance with the provisions of the law.
Article 70
The citizen shall enjoy freedom of belief and of religion; he can follow any
religion or follow none. All religions are equal before the law.
Article 71
The citizen shall enjoy inviolability of the person and the protection of the
law with regard to his life, health, honor and dignity. No one can be arrested
in the absence of a ruling by the People's Court, a ruling or sanction of the
People's Office of Supervision and Control except in case of flagrant
offences. Taking a person into, or holding him in, custody must be done with
full observance of the law. It is strictly forbidden to use all forms of
harassment and coercion, torture, violation of his honor and dignity, against
a citizen.
